1. Agreement to Terms

By accessing or using Tag My Link, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Tag My Link. They govern your use of the website (tagmylink.com), the web application (tagmy.link), and all related services.

2. Service Description

Tag My Link provides a digital business card platform, including a web application for profile creation and management. Users can share their digital cards via NFC tags, QR codes, or direct links for networking and contact sharing.

3. Account Registration

To use certain features, you must create an account on the Tag My Link platform. You agree to provide accurate information and maintain the security of your account credentials. You must be at least 16 years old to use our services.

4. Plans & Pricing

Tag My Link offers free and paid subscription plans. Current pricing, plan features, and any applicable trials are detailed on our Pricing page. We reserve the right to update pricing with reasonable notice to existing subscribers.

5. Payment Terms

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). By subscribing, you authorize us to charge your payment method automatically at the start of each billing period.

Seat Changes

If you add users to your subscription during an active billing period, the additional seats will be charged on a prorated basis for the remaining time in that period. This applies whether you are on a monthly or annual plan.

Cancellations & Refunds

You may cancel your subscription at any time. Upon cancellation, your plan remains active until the end of the current billing period. We do not provide refunds for unused time within a paid period. If you have already been billed for a period, access continues until that period ends — no partial refunds are issued as a standard practice. Exceptions may be made at our sole discretion or where required by applicable law.

Failed Payments

If a payment fails, we will attempt to notify you. Continued failure to pay may result in suspension or downgrade of your account to the free plan.

6. User Content

You retain ownership of any content you upload to your digital profiles on the platform. By using our service, you grant Tag My Link a non-exclusive, worldwide, royalty-free license to display and distribute your content solely as necessary to provide the service to you. This license terminates when you delete the content or close your account.

7. Acceptable Use

You agree NOT to use Tag My Link for:

• Illegal or unauthorized purposes.
• Sharing spam or unsolicited communications.
• Impersonating others or misrepresenting your affiliation.
• Distributing malware or harmful links.
• Automated scraping of the platform.
• Hosting or sharing content that violates any applicable law or third-party rights.

8. NFC/QR Interactions

Tag My Link supports sharing digital cards via NFC tags and QR codes. These may be physical products purchased separately, or tags and codes generated and used independently by the user. When someone interacts with your digital card (via NFC tap, QR scan, or direct link), we log the interaction timestamp, the viewer's IP address (for unique visitor counting), and which buttons or links they clicked. We do not identify the viewer unless they are a logged-in Tag My Link user. This data is displayed in your card analytics dashboard.

You are responsible for the content displayed on your digital card. By creating and sharing a card, you confirm that all content complies with applicable law and does not infringe any third-party rights.

9. Third-Party Services & AI

Our service integrates with third-party platforms to deliver features. We are not responsible for the availability or performance of these services. Key integrations include payment processing, email delivery, and social authentication providers.

When you use the in-app AI scanner to capture a physical business card, the image is processed by a GDPR-compliant AI service solely to extract contact information. The AI service does not retain the image after processing. You are responsible for ensuring you have the consent of the person whose card you are scanning.

10. Intellectual Property

Tag My Link and its original content (excluding user content), features, and functionality are the exclusive property of Tag My Link. You may not copy, modify, or reverse-engineer any part of our platform.

11. Privacy

Your use of Tag My Link is also governed by our Privacy Policy, which is incorporated into these terms by reference.

12. Disclaimer of Warranties

Our services are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Tag My Link's total liability for any claim arising from or related to these Terms or the service shall be limited to the greater of: (a) the amount paid by you to us in the 6 months preceding the event giving rise to the claim, or (b) €100 EUR. This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory. Nothing in these Terms limits liability for fraud, gross negligence, or where prohibited by law.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such failure results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government actions, internet or telecommunications failures, or actions of third-party service providers.

15. Termination

You may cancel your account at any time by contacting us. We reserve the right to terminate or suspend access to our service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, you will have 30 days to export your data (contacts, card data) using the available export tools. After this period, we may permanently delete your account and associated data.

16. Dispute Resolution

If you have a dispute with us, please contact us first at info@tagmylink.com. We will make a good-faith effort to resolve the matter within 30 days. If we are unable to reach a resolution, disputes shall be governed by the laws of Malta and resolved in the courts of Malta.

17. General Provisions

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full effect. These Terms constitute the entire agreement between us regarding our service and supersede any prior agreements.
